從司法實務觀點論一行為不二罰──以違規醫療廣告為中心【醫法新論】 試閱
A Focus on the Illegal Medical Advertisements─ Discussing the Principle of “Singularity act with impunity” from a Judicial Practice Perspective
「一行為不二罰」原則與行為數判斷之理論有關,並具有憲法上的位階。本文整理有關行為數認定之指標性司法實務見解,並就不同的行為類型與性質進行分析。本文以違規醫療廣告為核心,先揭示醫療法及「違規醫療廣告處理原則」中相關的法條,再闡述行為數認定之理論基礎及司法實務見解,並分析違規醫療廣告相關之法院判決,探討「違規醫療廣告處理原則」與實務見解相歧異之處,以及提示法院進行裁罰行為數認定之原則與指標,文末並提出醫療法及「違規醫療廣告處理原則」未來之修正建議。
The principle of “singularity act with impunity” is related to theories on the judgment of the number of acts and is enshrined in the constitution. The present study unites indicative opinions of judicial practice on the determination of the number of acts, conducting an analysis of the different types and natures of offenses. Focusing on illegal medical advertisements, we first highlight the relevant articles from the Medical Care Act and Principles for Addressing Illegal Advertisements for Medical Care, and elaborate the theoretical basis and judicial practice views on the determination of the number of acts, after which we analyze court judgments on illegal advertisements. We explore where judicial practice diverges from the Principles for Addressing Illegal Advertisements for Medical Care and put forward principles and indicators for courts to determine the quantum of punishment. In conclusion, we propose amendments to the Medical Care Act and Principles for Addressing Illegal Advertisements for Medical Care.
