Influences of Indigenous Peoples Health Act to Indigenous Body Politics
2023年5月26日立法院三讀通過原住民健康法(下稱原健法)改變了自1945年以來國家對原住民族的身體政治內涵,使長久以來的原住民族健康政策由計畫的層次提升為法律的位階,亦使原住民族健康政策的推動由法律議題轉變成政治議題,然而政府部門在執行原健法時如缺乏政治/民主責信,則很有可能引發國家對原住民族的身體政治出現合法性的危機與原漢族群關係的緊張,因此原健法的通過是否對原住民族健康不平等的改善可畢其功於一役則仍有待時間的驗證。
On May 26, 2023, the Legislative Yuan passed the“Indigenous Peoples Health Act,” marking a significant shift in the indigenous body politics’ implications of the nation-state since 1945. This elevated the longstanding indigenous health policy from a planned level to a legal status, and transformed the promotion of indigenous health policy from a legal issue into a political one. However, if government agencies lack political and democratic accountability in implementing the “Indigenous Peoples Health Act,” it could potentially lead to a legitimation crisis in the nation’s body politics of indigenous peoples, as well as tension in relations between indigenous peoples and Han Chinese in Taiwan. Therefore, it is still unclear whether the passage of the “Indigenous Peoples Health Act” will truly contribute to improving the health inequalities of indigenous peoples.
