Application of Early Neutral Evaluation in Medical Dispute

醫療爭議訴訟外解決機制是訴訟改革之重要一環，美國的經驗足以借鏡，法院的訴訟外解決機制有許多類型，本文介紹其中之一的早期中立評價程序(ENE)，佐以法院程序圖說明此程序的介入時機與其他程序的相關位置圖。

Medical malpractice reform in USA started about 4 decades ago. Alternative dispute resolution (ADR) is one of interest and important issue among it. Many types of medical malpractice ADR has been suggested or established. The time position of each is labeled in figure. Here we introduced one of ADRs-Early neutral Evaluation (ENE) as a possible ADR procedure for medical dispute in Taiwan.
