全民健康保險法第43條之規定,係臺灣轉診制度明文之法源依據。然而過去20年來,由於未能有效實現各級醫院間自行負擔費用之級距,民眾未經轉診而逕自到各級醫療院所接受醫療服務,導致醫療需求與成本不當拉抬。面對此一現象,衛生主管機關不積極矯正民眾就醫觀念,卻僅希望藉由總額與核刪制度,來限縮醫療服務提供者的費用支出。本文認為,當前醫療制度已近崩毀,醫療分級尚能調整制度的錯誤,讓醫療資源得以妥適分配,如何能落實醫療分級,係當前值得重視的問題。

英文摘要

The paragraph 43 of the National Health Insurance Act is the legal source of the system of referral in Taiwan. However, people went to hospitals without any referral in the past 20 years, because the level distance of hospitals in different levels wouldn’t fulfilled. The cost raised unorderly consequently. Instead correcting the custom of seeking a medical advice for the people, the authority took the strategy of a sum and canceling after confirming, so that the cost of medical service provider could be declined. This article believes that the medical system has been collapsed already and the medical grading system could fix the problems in the system. It would be the important issues that the medical resources could be properly divided and how the medical grading system could be fulfilled.
