Abandonee or Obligation? On Legal Issues of Inter-Hospital Patient Transfer

轉診之法律問題，除涉及基本之民法、刑法、醫師法、醫療法等，另外首重2007年修正公布之「緊急醫療救護法」，以及其所授權訂定之「緊急傷病患轉診實施辦法」。本次議題將討論：一、轉診醫院及醫師之義務；二、後送醫院及醫師之義務；三、病人及家屬自己要求轉診之法律要件及效果；四、救護車公司及救護車人員之義務；五、轉診醫院與救護車公司之權利義務關係。

The laws involved in inter-hospital patient transfer include Emergency Medical Act and its administrative rules besides basically Civil Law, Criminal Law, Medical Law and Physician Law. This issue will discuss about: 1. Obligations of transfer hospitals and physicians; 2. Obligations of receiving hospitals and physicians; 3. Legal issues of against advice discharge (AAD); 4. Obligations of ambulance companies and staffs; 5. Legal relationship between transfer hospitals and ambulance companies.
