On Surrogacy Regulations ─ A Global Perspective
就各國代理孕母法規的一般性規定來看，禁止商業性代孕是各國普遍的做法，而由寬轉嚴則是代理孕母法規發展的大體趨向。代理孕母法規所要解決的實質性問題，是不同人性需求之間的衝突及其立場選擇。代理孕母法規具有很強的倫理性，此一特徵使得其很多規定看似矛盾，但實則是更為功利和務實的做法。
It is a universal practice that most countries’ general legal provisions prohibit commercial surrogacy, while the general trend of the surrogate motherhood law is approaching hard control. The substantive issue of the surrogate motherhood law to be addressed is the conflict between different human needs and its position choice. Surrogate motherhood law has a strong ethnical characteristic, which makes its many provisions seemingly contradictory. But in reality it is a more utilitarian and pragmatic approach.
