Analysis on the Confusion of “Food Safety Standard”: A Dilemma in the Application of Food Safety Law
中華人民共和國「食品安全標準」從問世之後即存在著諸多困惑,如概念不清、與「質量標準」的異同、「企業標準」的混淆、「公法法域」與「私法法域」的效力不清等。這些困惑不僅造成了對食品安全法相關法規制度的認識誤區,同時也造成了食品生產經營者、管理者及相關法律從業者的無所適從。本文研究、分析這些困惑並嘗試給出回答,目的不僅是為了理論問題的澄清,同時也是為與食品安全法律相關之從業者釋疑解惑,以為法律的良好適用。
Since the “food safety standard” came out, there have been many puzzles, such as unclear concept, similarities and differences with “quality standard,” “confusion of enterprise standard,” “unclear effect of public law domain” and “private law domain,” etc. These puzzles not only lead to the misunderstanding of the relevant regulation system of Food Safety Law, but also lead to the confusion of food producers, managers and relevant legal practitioners. The purpose of studying and analyzing these puzzles and trying to give answers is not only to clarify the theoretical issues, but also to solve the problems for the relevant persons of food safety law and to apply the law well.
