Legal Study on the Criminal Responsibility of Operating Prophylactic Ablative Surgery in Taiwan
目前預防醫學及精準醫學已成為世界醫學界的顯學,隨著精準醫學計畫與基因序列資料庫的建立,基因與疾病之關係漸漸明朗,使得預防性切除手術也成為新興的醫療選項之一。臺灣實施預防性切除手術已經有一段歷史,但以基因或其他預測方法,將未來有可能罹病而仍完全健康之器官組織切除的手術,涉及醫界、衛生福利部是否認可,以及法律上可能該當傷害罪等問題,迄今未被重視。本文在鼓勵新興醫療科學技術研究發展、保障人民對於最新醫療科技的選擇權之情形下,針對預防性切除手術進行分類,並以醫療常規作為醫師注意義務之標準,探討醫師實施預防性切除手術在臺灣該當何罪,為人民生命身體健康權把關,希冀借由此法律實務分析能夠提供臺灣未來相關臨床案例或醫療糾紛思考方向。
Preventive medicine and precision medicine have become mainstream in the world medical field by now. With the establishment of Precision Medicine Initiative and Gene Databases, the relationship between diseases and gene sequences gradually become clearer, making prophylactic ablative surgery one of the emerging medical options for patients. Although prophylactic ablative surgery has been practiced in Taiwan for decades, the prophylactic ablative surgery which eradicates healthy organs that have high risks of diseases by using genetic or other predictive measures are not generally accepted by the medical professions and the Ministry of Health and Welfare. In addition, it also raises controversial legal issues especially in criminal law offenses of causing bodily harm. In the context of encouraging research and development in emerging medical technology and protecting the patients’ right to choose the latest medical options at liberty, this article intends to classify the prophylactic ablative surgery, and then take the medical custom as the standard of physician’s duty of care to analysis on the criminal responsibility of operating a prophylactic ablative surgery in Taiwan. Hoping this legal practice analysis will be able to provide a guideline for relevant clinical cases or medical disputes which may happen in Taiwan in the future.
