Current Practice and Regulatory Suggestions of Surrogacy in China
代孕問題事涉輔助生育技術的應用，並延伸諸多社會倫理與法律適用之疑義，惟基於目前社會發展與人民對於代孕需求等考量，從而如以法律就代孕問題進行法律規制，自然具有其現實意義。但是，代孕的合法化仍不宜操之過急，尚須審慎評估其對社會、倫理、道德、法律及社會公序良俗所可能帶來的衝擊與負面影響；如未來代孕予以開放，亦應定有嚴格的條件限制與管理。本文首先梳理代孕在肯否兩方的論理基礎，復於文末提出有限開放代孕時可作為考量的幾點建議。
Surrogacy involves the application of assisted reproductive technology, and extends many social, ethical and legal issues. Considering the social development and people’s demand for surrogacy, it is significant to regulate surrogacy by law. However, the legalization of surrogacy should not be carried out too quickly. The possible negative impacts should be carefully evaluated, which caused by surrogacy on the society, ethics, morality, law and public order and good morals. If the surrogacy is to be applied in the future, it should be strictly restricted and regulated. This paper analyzes the ethical opinions for and against surrogacy, and it offers the practicable suggestions on legally regulating surrogacy.
