Allocation of Civil Liability of Applying AI-Assisted Image Analysis for Diagnosis under Japanese Law
本文探討使用AI醫學影像診斷輔助系統（AI影像輔助系統）之民事責任分配問題，先究明日本對於醫療用AI於臨床實踐之性質之基本見解，再循序分析AI影像診斷之風險，進而綜合歸納日本法上關於使用AI影像輔助系統之民事責任分配之見解，以期建構系統關係人間分配民事責任的準則。吾人可預見日後之醫療從業人員，將一面注意AI影像輔助系統之限制，按照醫療水準建立對該等系統應有的信任，一面保持健全的懷疑，與AI共存。
This article researches the allocation of civil liability of applying AI-Assisted Image Analysis for Diagnosis (AI-assisted Image System) between the related parties. This article first investigates Japan’s basic view on the nature of AI in clinical practices, then analyzes the risks of AI-assisted image analysis, and comprehensively summarizes the opinions on the allocation of civil liability of applying AI-assisted Image System under Japanese law, in order to find out the criteria for the allocation of civil liability among the related parties. We can foresee that the medical practitioners in the future will pay attention to the limits of AI-assisted Image System and build their due trust in such a system according to the level of care in clinical practices, while maintaining sound doubts and coexisting with AI.
