Judicial Review over the “Advertisement for Healthy Foods”: Discussions on Related Judicial Interpretations
「保健食品」現歸類於一般食品,受「食品安全衛生管理法」之規制。食安法對食品定有諸多限制,本文所探究者係「廣告」的部分,主要即第28條第1項及第2項:「食品、食品添加物、食品用洗潔劑及經中央主管機關公告之食品器具、食品容器或包裝,其標示、宣傳或廣告,不得有不實、誇張或易生誤解之情形。食品不得為醫療效能之標示、宣傳或廣告。」在主軸上即分析本規定(及其子法)之相關憲法爭點,包含所涉及的基本權利以及欲為合憲性審查時之「審查基準」;而在論述上就大法官解釋中對相關廣告規範所曾表示之見解為結合印證,亦一併探究「裁判憲法審查」制度施行後所可能涉及的問題。
The so-called “healthy food” is defined by the Act Governing Food Safety and Sanitation as “general food” which does not have any medical effect. This article aims to discuss Sections 1 and 2, Article 28 of the Act which provides that “the labeling, promotion or advertisement of foods, food additives, food cleansers and food utensils, food containers or packaging designated by the central competent authority in a public announcement shall not be false, exaggerated or misleading” and “foods shall not be so labeled, promoted or advertised as having medical efficacy” in connection to Constitutional debates over concerned fundamental rights and the benchmark of judicial review. It shall elaborate related Judicial Interpretations as well as discern possible problems under the system of judicial review over court decisions.
