Overview the Amendments of Mental Health Act
精神衛生法於2022年12月14日全文修正通過，對我國精神衛生服務體系有莫大影響，本文就新法規定約略介紹，並著重在協助就醫、強制社區治療與住院等規定。新法重新定義嚴重病人、增定社區支持、重整各機關之權責；其次，布建社區心理衛生中心及多元社區支持，以及保護病人權益、強化通報及建立危機處理機制；最後，強制住院改由法院裁定而強制社區治療仍由審查會許可，並規定相關聲請、審理、執行以及第一審參審員之規定。
Mental Health Act, which is amended in 2020/1/15, change greatly our mental health system. This article will broadly introduce this amendment and focuses on the assisting access to medical care and mandatory hospitalization. Frist, the amendment redefines severe patient, defines community support and reorganizes administration’s responsibility. Second, the amendment also founds Community Mental Health Center and diverse community support, while the amendment greatly protects patients rights and builds reporting system and crisis management mechanism. Last but not least, mandatory hospitalization is not decided by the administration but the court, and the other hand, the Community Treatment Orders is still decided by the administration. The amendment makes the rules for application, review, execution and lay judges.
