最高法院94年度台上字第2676號刑事判決對於告知說明範圍具有劃時代的影響，其中關於治療之成功率（死亡率）及醫師之專業能力應為說明之內容，非法所明定應說明之事項，究竟是否應成為取得病人同意前應告知之範圍，從美國各州最高法院告知同意法則之應說明事項之演變比較，可以用來審視最高法院見解之妥當性。
The judgment appeal No. 2676 of the Supreme Court in 2005 has had a landmark impact on the scope of disclosure. According to which, it is the content of the disclosure to inform the success rate, i.e. the mortality rate, and the physician’s professional ability. But they are not the statutory matters. It might review the appropriateness of the judgment of the Supreme Court to compare it with the development of the statutory matters concerning the informed consent in the Supreme Court in the US.
