Physician’ s Obligation of In-person Diagnosis in the Digital Age: A Discussion of Online Consultation
現今社會高度仰賴網路活動與通訊軟體，進而衍伸出線上的醫療活動。因應疫情而出現的視訊問診應屬於醫師法第11條第1項但書的例外要件，可判定其為合法，至於線上討論區的問答，則與前開規定內容不符，應已違反醫師法之規定。但需注意的是，視訊問診在本質上與醫師的親自診療義務有所牴觸，為確保醫療品質與維護醫病關係，前述狀態仍應該受到合理的限制。
Nowadays, we rely heavily on internet activities and communication software, and that is how online medical activities come from. However, the online forum’s questions and answers don’t meet the preceding provisions and should be in violation of the Physicians Act. It is important to note that video consultation is inherently in conflict with the physician’s obligation to diagnose in person medical treatment. In order to ensure the quality of medical treatment and maintain the doctor-patient relationship, the video consultation should still be under reasonable restrictions.
