Case about Dental Implant: A Result without a Cause
本件牙醫師於2017年6月19日為病患施行植牙手術，病患術後有發生下唇麻痺之現象，病患主張牙醫師於施行植牙手術前，未告知右下齒槽骨神經有受損之可能風險，且違反植體末端與下齒槽骨神經管間應保持2∼3mm之安全距離之醫療常規，惟兩次醫事審議委員會之鑑定均認定醫師手術符合醫療常規，法院判決亦認為手術與傷害並無相當因果關係，本文就本案判決爭議作比較分析，然病患傷害之原因依舊不明。
In this case, the dentist performed implant surgery on the patient on June 19, 2016. The patient suffered lower lip paralysis after surgery. The patient claimed that the dentist did not inform him of the possible risk of damage to the right inferior alveolar nerve prior to the dental implant surgery, and violated the medical practice of maintaining a safe distance of 2-3 mm between the end of the implant and the inferior alveolar nerve canal. However, the two evaluations by the Medical Review Committee all confirmed that the dentist’s operation was consistent with medical practice. In addition, the court ruled that there was no significant causal relationship between the surgery and the injury. This article compares the controversy over the verdict in this case, but the cause of the patient’s injury remains unclear.
