法國訴訟外醫療爭議處理制度初探【醫法新論】 試閱
A Preliminary Study on Non-litigation System of Medical Malpractice Dispute Resolution in France
法國透過2002年3月4日法案（Kouchner Act）建立新的訴訟外醫療事故爭議處理制度，隨後成立專責機構來處理醫療爭議的調解與嚴重醫療事故的國家補償方案。這套制度有助病人更快速、便利且平等地獲得補償，維繫健全的醫病關係。本文介紹法國此制度的運作方式，作為臺灣即將施行醫療爭議處理專法的借鏡。
The French legislature established a new non-litigation medical malpractice dispute resolution system with the Act of March 4, 2002 (Kouchner Act). Then, specialized agencies were set up to handle medical dispute mediation procedure and national compensation for victims of serious medical accident. The system aimed to compensate for the patients timely, conveniently and equally, and to maintain the healthy physician-patient relationship. This article explored how the French model works, and served as a reference for Taiwan’s upcoming implementation of a special law on medical dispute resolution.
