探討使用通訊心理諮商之核准適法性【本期企劃】 試閱
Exploring the Legal Issues of Requiring Approval for the Use of Tele-Counseling
2019年衛生福利部頒布「心理師執行通訊心理諮商業務核准作業參考原則」，要求進行線上諮商前須先經過核准，否則將以違反心理師法論處。本文先提出三個爭議點，並介紹「遠距健康服務」與「諮商的本質」，最後從法律、諮商專業及國外做法討論使用通訊心理諮商須先經過核准之問題，藉以呼籲廢止沒有法源依據之核准作業參考原則。
In 2019, the Ministry of Health and Welfare issued the ‘Reference Principles for the Approval Process of Psychologists Conducting Tele-Counseling.’ Psychologists must obtain approval before conducting tele-counseling, otherwise, it would be considered a violation of the ‘Psychologists Act. This paper first presents three issues, then introduces ‘telehealth’ and the nature of counseling. Finally, it discusses the three issues from the perspectives of law, counseling professionalism, and international practices, aiming to call for the abolition of the ‘Reference Principles for Approval’ that lacks a legal basis.
