Physicians' Diagnoses as the Basis for the Objective Duty of Care in Physical Therapy
From the perspective of criminal liability for negligence, a physician’s diagnosis constitutes a necessary prerequisite for physical therapy. Its normative significance lies in enabling the physical therapist, before administering treatment, to foresee potential risks to the patient’s legally treatment, to foresee potential risks to the patient’s legally to prevent them. Accordingly, any physical therapist who performs manual therapy without first obtaining a physician’s diagnosis commits a treatment error that constitutes a breach of the objective duty of care.
