A Case about Testicular Necrosis after Resection: Objective Negligence and Its Evaluation Method in Medical Criminal Law
違反客觀注意義務向來是醫療人員成立過失犯的關鍵。當代的過失犯理論仍有眾多爭議，不免產生相異的解釋結果。儘管如此，德國的實務與學說見解在醫療刑法的範疇發展出相對穩定的論理結構。本文以臺南地方法院的「睪丸切除手術案」作為分析基礎，說明醫療注意義務應有的內涵，並且依此提出一套完整的犯罪評價步驟。
Violation of objective duty of care has always been the basis for medical personnel to establish negligence. There are many controversies in contemporary negligence theories, which inevitably lead to different interpretations. Nevertheless, German judgments and academics have developed relatively stable interpretations in the field of medical criminal law. This article uses the Tainan District Court’s “Testicular Removal Case” as the analysis basis to explain the connotation of medical duty of care, and propose a complete set of review steps for the judgment of negligent crime.
