Informed Consent in the Standard form Contracts of Frontier Medicine
尖端醫學的快速發展衍生無限的商機，對於病人及消費者的保護，如果只靠傳統民法概念意思表示的一致來解讀定型化契約的效力，對消費者的保護並不足夠。本文藉由分析臺美臍帶血銀行衍生的爭訟，認為將知情同意原則擴大應用到尖端醫學的產業，才能確保尖端醫學對社會的影響是利大於弊。
The rapid development of frontier medicine has brought about enormous business opportunities. Determining whether standard form contracts have become effective due to mutual agreement based on traditional contract laws cannot adequately protect patients and consumers. This article analyzed one Taiwanese and one American law suits arising from private cord blood banking disputes. I argue that only by expanding the application of informed consent principle to the frontier medicine industry can the society ensures that frontier medicine will have more benefit than harm.
