白袍落難記:醫師勞動權益保障的下一步【月旦時論】 試閱
Path to Protection of Doctors' Labor Right
近期幾起受僱醫師勞權爭議引發廣泛討論,再度喚起受僱醫師未受勞動基準法保障議題之重視。本文首先回顧受僱醫師從未有任何保障,直至部分住院醫師受勞動基準法保障之歷程,繼而以實際判決說明受僱醫師若未受勞動基準法保障,可能遭受之不平等待遇,包含工作權保障不彰、最低服務年限條款與不平等違約金,以及競業禁止條款的不對等。筆者期待透過本文之回顧與分析,燃起普羅大眾對此議題之關注及討論,謀求受僱醫師適當之勞權保障。
Recently, some labor disputes of doctors in Taiwan attracted much attention and raised concern about the issue of employed doctors lacking basic legal protection. In this article, we elaborated the history of employed doctors not being covered by Labor Standard Act. We also depicted doctors’ inequality of right in the perspectives of employment stability, minimum service period agreement, unequal punitive damage and after-resignation business strife limitation agreement by introducing several adjudications. We hope this article would contribute to the discussion of appropriate legal protection about employed doctors’ interest of work.
