Do Right Things at the Right Time: Policy Reflections on Patient Right to Autonomy Act and Hospice in Taiwan
醫事檢驗師，或者簡稱醫檢師，是在現代複雜及高度專業化醫療組織中，負責醫事檢驗的專門職業人員。醫事檢驗師法第12條第1項及第34條規定確立了醫檢師的法定執業範圍，然其內容實有賴學界及主管機關的解釋，方得以依循並有明確認知，除可避免非醫事人員執行醫事檢驗業務外，亦可讓醫檢師在執行醫事檢驗業務時不會侵犯到其他醫事人員的專屬醫療業務。再者，隨著新興生物技術的法展，許多醫學相關的檢查與操作，亦與民眾的醫療權益息息相關，未來在修法監管時亦可考慮醫檢師的專業，在適合的領域及範圍作為醫檢師的法定執業範圍內。
Medical laboratory technicians are specialized professionals responsible for performing medical tests in modern, complex, and highly specialized medical organizations. Article 12, Paragraph 1, and Article 34 of the Medical Laboratory Technician Act establish the statutory scope of practice for medical laboratory technicians. However, their content relies on the interpretation of academia and competent authorities for clear adherence and understanding. This not only prevents non-medical personnel from performing medical laboratory tests, but also ensures that medical laboratory technicians do not infringe upon the exclusive medical services of other medical personnel when performing medical laboratory tests. Furthermore, with the legal development of emerging biotechnology, many medical-related examinations and procedures are closely related to the public’s medical rights. Future legislative amendments could also consider the expertise of medical laboratory technicians and include appropriate areas and scopes within their statutory scope of practice.
