國民年金與勞保失能給付競合之問題【本期企劃】 試閱
The Issue of Concurrent Eligibility for Disability Benefits under the National Pension and Labor Insurance Systems
國民年金具有社會保險之補充性質,對於因傷病無法繼續工作而退出勞工保險之人,可以補足其老年保險之年資。但因當事人已經請領勞工保險失能給付,縱使其轉保後亦能滿足國民年金身心障礙給付之要件,依規定卻只能擇一請領。此乃涉及社會保險給付競合之問題。對此,本文從社會保險學理分析兩種社會保險制度以及相關給付之差異,並說明主管機關對給付競合情形之處理原則。
The National Pension serves as a supplementary social insurance system, enabling individuals who exit Labor Insurance due to illness or injury to continue accumulating coverage for old-age benefits. However, recipients of Labor Insurance disability benefits are, by regulation, barred from simultaneously claiming National Pension disability benefits, even if eligible. This presents a case of overlapping entitlements within social insurance. This paper analyzes the legal and structural differences between the two systems and discusses the competent authority’s principles for resolving benefit conflicts.
