Does a Duty to do EGG belong to the Doctor after the Patient´s Taking Amisulprid?
病患因服用由醫師Y開立的200毫克Amisulprid處方藥，導致心律失常性心臟衰竭而死亡，其家屬X主張Y應對其治療失當——後者並未對病患進行心電圖檢查以追蹤其服用藥物後的身體狀況，進而及時更換藥物以免病患死亡——造成病患死亡負損害賠償責任。
第三審法院認為，第二審法院並未審酌專業鑑定之意見，認為本案心電圖檢查僅屬建議而非必要之意見，且忽略系爭藥物可能導致心血管系統副作用之事實，於醫療準則之判斷顯有瑕疵。
The patient took the medicine with 200 mg Amisulprid but died of the arrhythmia heart failure. The patient’s family X accused the doctor Y of medical misconduct that Y should take EGG for the patient to know his situation after taking the medicine, so Y could change the medicine to avoid the death of the patient.
The supreme thought that the court didn’t take the expert wintess into consideration, didn’t see the EGG to patient as a necessity instead of only a suggestion. Beside, the court also ignored the fact that the medicine in this case might cause the side effect of cardiovascular system so the judgment was in error.
