臺灣正追求基因研究的快速發展,由於原住民比一般臺灣民眾容易被採檢,從而發生許多研究倫理爭議事件,諸如以義診名義抽血、過度採檢、污名化報導等。學界為此要求政府應全面提升研究倫理審查至所有人體研究,更應針對原住民族給予集體同意權之保障。對此立法部門於2005年通過保障原住民族集體同意權的原住民族基本法,以及2011年通過全面保障個人同意權的人體研究法。行政部門則根據上述兩法,於2016年推出「人體研究計畫諮詢取得原住民族同意與約定商業利益及其辦法」,並委託成立專管中心,實際執行原住民族人體研究倫理審查。

英文摘要

The Taiwan indigenous genetic researches became a hot research topic in Taiwan in the recent 20 years. However, many ethical disputes came along with those researches. Some indigenes were multiple sampled by different researchers but never been inform consented, and some tribes were stigmatized by incorrect results. To response those ethical disputes, Taiwan Legislative Yuan formulated the “Indigenous Peoples Basic Law” which works on a basic protection of indigenous collective right in 2005, and the “Human Subjects Research Act” which work on a completely individual inform consent protection in 2011. Taiwan Central Council of Indigenous Peoples then stipulated the “Regulation for the Consultation of Indigenous People’s Consent and Agreed Commercial Benefits for the Research Involved Indigenous People” in 2016, and establishes a manage center to push it works well.
