Conflicts among Ethics, Privacy and Public Interests: A Discussion of Evidence Admissibility in the Golden State Killer Case

美國加利福尼亞州警方利用民間建置的基因資料庫，逮捕了一名在40餘年前涉及多起強制性交與殺人案件的嫌疑人，但除了證據能力容有疑義外，偵查活動也可能侵害使用者的資訊隱私，公益與基本權的拉扯表露無遺，值得吾人深思。

This article tries to clarify the conflicts between ethics, human rights and public interests. Despite of the California police arresting suspects through the online DNA database, however there were several ethical and legal issues being clarified. On the ethical side, it was inappropriate to use the online DNA database without the consent of all users. And the investigation of police may infringe on users’ privacy at the same time. Despite of this case related to public interest, the admissibility of evidence from commercial online DNA database still needs to be confirmed.
