相對於非醫療行為的其他行為，因醫療行為具有諸多特性，致使在醫療刑事案件中要將醫療行為轉化為法律上的事實行為而進一步作法律適用時，必須作特殊的考量。醫療刑事案件中，法律是否能正確適用的關鍵乃在於對發生於醫療領域之具體事實特性能否有正確的認知。而對於醫療領域具體事實特性的認知，則是先要全面認識和了解醫療行為的概念、本質特性及其界定的標準，才有可能精確掌握之。
