食品安全議題在臺灣長期以來備受關注,而就此與民眾所切身相關的問題上,需仰賴不同學科領域的專家意見,以期徹底解決食品安全的爭議,進而確保大眾能夠吃得安全。一連串的修法與不斷舉辦的研討會,似乎未能阻止食品安全事件一再發生,本文嘗試回到食品安全法制所應當面對的「風險」,並透過「預警原則」重新思考法律制度之應然。

英文摘要

Food safety has been a hot issue is Taiwan for a while. For these problems, which are so important in our daily life, are concerning different expertise, such as food science, law, economy, and the public policy, but it seems that there is no one can provide the panacea to resolve all questions for food safety. No one can ensure that we can eat safely, even though the government has proposed many amendments to the existing act and regulations. None of them could possibly prevent food scandal from happening. In this paper, I would like to focus on “risk” to clarify its meaning, through the understanding of the principle of precaution, the very fundamental basis for the legal system of food safety. Further, after reviewing current legal structure, I will try to propose some recommendations to remodel the thinking for food regulations, in the way it is supposed to be, rather than the misunderstanding of other people, for ensuing food safety for the public.
