Electronic Cigarette under German Pharmaceutical Affairs Act and Tobacco Hazards Prevention Act

電子菸作為新型態之菸品類型，是否應受現行藥事法及菸害防制法之管制，在德國法學界亦存在相當多之討論，本文擬呈現德國對此議題之討論方式。

Electronic cigarette is regarded as a new type of cigarette. However, the issue whether it falls within the scope of current Pharmaceutical Affairs Act and Tobacco Hazards Prevention Act remains legally disputed. This article is aimed to present the related discussions in Germany.
