Rethinking the Issue of Allowing the Use of Predictive Genetic Testing Results in Insurance Underwriting
In recent years, the lowering costs of predictive genetic testing has facilitated its prevailing and again raise the issue: Whether predictive genetic test results should be permitted to use in insurance underwriting. This note first explores the opportunity the progress of genetic testing technology brings to the insurance industry so as to verify the urgency of discussing the above issue. Second, dialectic approach will be applied to analyze and respond to both pros and cons regarding insurers’ utilization of genetic testing result. Third, British model will be introduced and proclaimed as a model which best balance the interests of consumers and insurers. Last, based on the dialectic analyses and British model, this note will answer the question: How Taiwanese Law should reflect on this issue.
