Constructing the Prevention of Medical Disputes with the Module of Three-Section and Five-Levels and Multi-Mechanism
本文是以預防醫學三段五級理論為出發，從事前預防、事中介入及事後處置，建構出醫療爭議預防的三段五級模式，其內涵包括：初段預防的醫病協商與醫療專業、次段預防的風險辨識與及時介入，以及末段預防的補償救濟與訴訟準備，希冀能以預防及訴訟外的多元醫療爭議處理模式，避免醫療爭議走向訴訟。
On the basis of the theory of three-sections and five-levelsin the preventive medicine, the prevention of medicaldisputes would be constructed in this essay with theprevention, the intervene and the treatment. It includesthe medical consultation and the medical profession inthe primary prevention, the recognition of the risk in thesecondary prevention and the intervene in time as wellas the preparation of the compensation of remedy andlawsuits in the prevention in the last stage. By means of theprevention and the alternative medical dispute resolutionsmight the medical disputes not be handled with lawsuits.
