Some Comments for an Evaluative Medical Mediation being enforced in Taichung District Court
臺中地方法院自2012年9月起試行「雙調解委員」制度，迄今已進入第九年，本文爰參酌本院2012年起醫療調解統計及筆者於2016年間對醫療訴訟當事人及調解委員、司法官問卷等資料，從本土量化實證分析結果，認醫療調解應採「敘事型調解」模式。該模式將從2021年5、6月間開始試行，期望調解發揮紛爭解決功能，重塑醫病之信賴關係。
It has been nine years for enforcing double members for the mediation committee in Taichung District Court since September 2012. On the ground of the statistics for the medical mediation since 2012 in Taichung District Court and the result of local quantitative empirical analysis coming from questionnaires for the parties of medical litigations, members for the mediation committee and judges, the narrative mediation would be recommended and it would be enforced since May and June 2021. It will have function for solving disputations, reconstructing the trust relationship between the physicians and the patients.
