The Assessment Process and Related Skills of Forensic Psychiatric Evaluaiton
刑事精神鑑定係以鑑定人的專業，以精神醫學的原理與方法，奠基於可靠的事實與資料，形成鑑定意見，而符合刑事訴訟法之要求。因以鑑定的評估程序，以及所使用的鑑定技術，是達到鑑定結論的重要過程。本文首先說明，鑑定的目的在於發現真實與實踐公平正義，有別於醫療的倫理價值選擇，而文化因素也應視為鑑定倫理的一部分。為了鑑定品質的追求，本文提出可以參考的程序要求以及建議運用的鑑定技術，包括：評估程序、鑑定評估內容與項目、輔助測驗及檢查、診斷及精神鑑定報告格式、內容與意見。最後並介紹特殊個案與情境的處理原則。
Forensic psychiatrists use the expertise of the psychiatrist and the principles and methods of psychiatry, based on reliable facts and materials, to form forensic opinions that meet the requirements of the Criminal Procedure Law. The evaluation procedure and skills for such evaluations are crucial to reaching the forensic conclusion. This article first explains that the purpose of forensic evaluations is to discover the truth and pursuit justice, which is different from the general ethics of medical care. And cultural factors should also be regarded as a part of ethics. Then, pursuing the quality of the forensic evaluation, the author puts forward the procedural requirements and the evaluation techniques that could be used, including assessment procedures, assessment contents, adjunctive tests and examinations, diagnosis, and psychiatric report formats. Finally, the handling principles of special situations are introduced.
