Defining the Standard of Care in the Clinical Diagnosis of Oncology
近5年，中國大陸腫瘤臨床診斷領域的醫療損害糾紛整體呈增長趨勢。涉及腫瘤臨床診斷錯誤的典型醫療責任事故，更是引發國民的憤怒與焦慮。規範醫師臨床診療行為、提升腫瘤診斷準確度，已成為社會各界的關注焦點和共同目標。中國大陸民法典第1221條所確立的診療時醫療水準看似足以作為醫師腫瘤臨床診療的注意標準，實際上卻只是影響醫師腫瘤臨床診斷的注意標準要素之一，難以準確衡量部分個案中醫師的注意能力，也無法滿足保障診斷品質的實際需要。因此，本文從影響醫師腫瘤臨床診斷的注意標準之要素出發，探索建立醫師在腫瘤臨床診斷領域的診療品質保障注意標準。
In the past five years, the disputes of medical damage caused by errors on tumor diagnosis in china are increasing. Typical medical liability accidents involving clinical diagnosis errors in tumors have aroused national anger and anxiety. Standardizing the clinical diagnosis and treatment behavior of physicians and improving the accuracy of tumor diagnosis have become the focus and common goal of all walks of life. It seems that Article 1221 of the “Civil Code” establishes the standard of care during treatment for physicians could be adapted to the clinical diagnosis and treatment of tumors. In fact, the duty of care during medical treatment is only one of the elements of the standard of care that affects the physician’s clinical diagnosis of tumors, and too far to meet the requirements on the quality of diagnosis. Therefore, this thesis will start from the elements which affect the physician’s standard of care in clinical Diagnosis of oncology, then explore and establish the quality assurance standard of physician’s medical care.
