強制社區治療之困境與人民基本權【本期企劃】 試閱
The Dilemma of Compulsory Community Treatment and People’s Basic Rights
現行強制社區治療實施至今約15年,根據統計,每年申請強制社區治療之案件數低,執行成效不佳,即便主管機關得洽請警察與消防機關協助執行,仍然難以解決強制社區治療的執行困難。檢視強制社區治療的執行過程,嚴重病人之人身自由雖未被完全剝奪,但仍會受到限制,此外尚有人格權、身體權、財產權及醫療自主權被限制的可能,現存之法規範對於治療執行者如何處理與人民基本權保障相衝突付之闕如,導致執行現場常陷於無法作為或積極違法的困境。立法機關應參照憲法第23條、大法官第443號解釋或其他相關規範,訂定合憲可行的法律依據,解決強制社區治療難以執行的問題,方有活化強制社區治療制度的可能。
The compulsory community treatment has been implemented for about 15 years. According to statistics, the effectiveness of compulsory community treatment is poor. Even if the police and fire department are mandated to help the treatment teams, the difficulties in enforcing compulsory community treatment are remained unresolved. Focusing on the execution of compulsory community treatment, although the personal freedom of severely mental ill patients is not completely deprived, it could be restricted at some points during the execution. In addition, there are other fundamental rights may be restricted. The existing regulations do not provide clear guidelines for treatment practitioners on how to handle conflicts with the people’s fundamental rights. Therefore, dilemma of being unable to act or actively violating the law is the major obstacle for the execution of compulsory community treatment. The legislative authority should reviewing the whole regulations and provide a sound statute to solve the conflict between violating fundamental right and compulsory community treatment.
