勞動能力減損由「減損程度」、「勞動年數」與「所得額」構成,而目前缺乏針對「減損程度」整體分析的文獻。本文整理近年法院判決見解,闡明職業醫學理論與鑑定實務觀點,就勞動年數起算時點、勞動能力減損鑑定理論、鑑定形式要件、因果相關評估、最佳醫療改善、鑑定方式選擇(AMA障害分級或勞保失能等級)、鑑定內容爭議、永久失能法應用等議題,提出相關建議,提供醫師鑑定、律師攻防與法官判決參考。

英文摘要

The decreased laboring capacity is composed of “degree of impairment,” “working years,” and “income”. Currently, there is a lack of literature that comprehensively analyzes the “Degree of decreased laboring capacity” in Taiwan. This article summarizes recent court judgments to elucidate occupational medicine theory and assessment practices, focusing on the starting point for calculating working years, theories of impairment assessment, formal essentials of assessment, causality determination, maximal medical improvement, selection of assessment methods (AMA Guides to the Evaluation of Permanent Impairment or labor insurance disability level), disputes over assessment content, application of Permanent Disability Assessment Method. Relevant suggestions are proposed to provide reference for physicians’ assessments, lawyers’ arguments, and judges’ rulings.
