醫療刑事訴訟中，關於不純正不作為犯之比例甚高，對於醫師未為期待之作為與造成負面醫療結果間之假設因果關係，就審查順序應優先於作為義務是否違反，而就鑑定意見能否正確理解，重點在於鑑定問題之提出，並本於刑事責任罪疑唯輕之基本原則加以判斷。
It is the impure omissions which are happened often in the medical criminal lawsuits. As to the hypothetical causality between the physician’s unintended actions and the negative medical results, the order of the examination should take precedence over whether the obligation to act has been violated; as to whether the assessment opinion can be correctly understood, it should be focused on the question for the assessment. The judgment should be based on the basic principle of the criminal responsibility in dubio pro reo.
