住宿式長照機構規範違憲疑慮之探討【本期企劃】 試閱
Discussion on Concerns about the Unconstitutionality of Regulations for Residential Long-term Care Institutions
自長期照顧服務法實施以來，政府對於長照服務在體系法制化及機構產業化等均有政策迷失之情形，除了長照基金之分配及運用存有疑慮外，尚有在地老化之解釋不當，以及財政財源之來源等爭議。另外，長照機構法人化對「機構住宿式」服務之限制，猶欠缺應對未來有大量長照服務需求產生時之對應措施，屆時恐會產生另一波的動盪；至於住宿式長照機構遭「長期照顧服務申請及給付辦法 」排除適用之問題，更成為長照服務體系法制化與機構產業化之重大障礙，本文建請政府儘速正視以上問題，並廣納專家、學者、長照業者與人民等意見，俾使我國長期照顧服務能臻至健全、永續發展。
