Implementation of the Right to Living Independently under Article 19 of the CRPD in Taiwan
臺灣實施自立生活支持制度已經超過10年,近期行政法院也作成了關於個人助理服務時數的判決,援引身心障礙者權利公約,肯定身心障礙者在社區生活的平等權利。然而,由於自立生活支持法制欠缺、預算規模成長有限、對自立生活與融合社區精神的誤解充斥,障礙者申請使用或增加個人助理時數仍面臨歧視、申請與需求評估流程紊亂、不合於公約要求等問題,行政救濟過程也受限於訴訟法制。
Assistance for living independently has been available in Taiwan for over a decade. Recently, an administrative court ruling regarding personal assistance was made, citing the Convention on Rights of Persons with Disabilities to acknowledge the right of disabled persons to live in the community on an equal basis with others. Unfortunately, due to the lack of legislation, limited budget growth and utter misunderstandings about living independently and being included in the community, disabled persons still face discrimination, a confusing application and assessment process that contradicts the Convention when applying for personal assistance, and even further barriers when pursuing their rights in courts.
