Analysis on the Revised Code of Criminal Procedure Regarding Access to Justice for Persons with Disabilities
本文認為本次修法在近用律師、辯護人、輔佐人協助的訴訟照料方面,不以被告或犯罪嫌疑人是否持有身心障礙證明為限,較為符合社會模式,應屬進展。至於在具結能力、停止審判方面,仍是以心智能力不健全、醫療模式為基礎,使其他心智障礙者不能在與其他人平等基礎上具結作證,也使精神或其他心智障礙者在心智能力功能回復之前,不能在與其他人平等基礎上接受刑事審判,有違反身心障礙者權利公約第12條第2、3項、第13條第1項規定的疑慮。
This article believes that this revision is more in line with social model and should be considered progress in terms of access to lawyers, public defenders, and assistants, because it is not limited to whether the defendant or criminal suspect holds a certificate of physical or mental disability. However, as for the ability to make an affidavit and the suspension of trials, both still based on mental incompetence and the medical model, this revision prevents persons with other mental disabilities from being able to make an affidavit and testify on an equal basis with others, and also prevents persons with mental or other intellectual disabilities from receiving a criminal trial on an equal basis with others before their recovery. They raise the concern of violating Article 12, paragraphs 2 and 3, and Article 13, paragraph 1, of the CRPD.
