The Duty to Informed Consent and Criminal Liability: Understanding the Framework for Negligence Offenses

醫師違反告知義務時，能否構成過失不法的刑事責任，長期以來的論證莫衷一是，醫療法的研究領域中，多數見解排除這樣的可能性，不過本文認為這樣的說詞顯然忽略了過失犯的審查架構，進而對於告知義務的角色存在謬誤的認知，似有必要加以釐清。

The long-standing debate on whether a physician’s violation of informed consent rule constitutes a criminal offense has been confused. Most scholars in medical law tend to oppose this view. However, the author argues that such assertions do not correctly understand criminal law theory. Therefore, they have arrived at a mistaken conclusion that needs clarification.
