Challenges in Border Control of Food Imports in Taiwan: Reflections on the “Sudan Red” Incident

隨著糧食自給率逐年下降,我國對於進口食品之依賴日漸加強,對於主管機關而言,食品安全之管制困難度也跟者提高。而2024年年初爆發的「蘇丹紅」事件更彰顯問題的嚴重性,實際上進口食品之食品安全風險普遍存在,而不因來源地不同有所區別。本文以蘇丹紅案為例點出我國食品邊境管制的困境,而歐洲聯盟(下稱歐盟)之食安管制規範向來以嚴格著稱,從比較法的觀點闡述我國輸入食品邊境管制之缺陷,並進而提出改善的方向。

英文摘要

As Taiwan’s food self-sufficiency has progressively declined, it has become increasingly reliant on imported food, which has raised the challenge of food safety regulation for the authorities. This issue has been brought to the forefront by the “Sudan Red” incident that broke at the beginning of 2024. As a matter of fact, food safety risks associated with imported food are pervasive and do not vary significantly with the country of origin. Using the Sudan Red case as an example, this article illustrates the difficulties Taiwan faces in controlling imported food at its borders. Comparing Taiwan’s border control measures to the European Union’s renowned and rigorous food safety regulations, this study identifies Taiwan’s shortcomings and identifies directions for improvement.
