Legal Issues Regarding Using Human Medicine on Pets
藥事法禁止藥商及藥局販賣動物用藥，並限制人用藥僅得流通於醫療機構、藥局及藥商間。2012年某衛生局以人用藥廠所製造之藥品，販售給獸醫診療機構供動物使用，違反藥事法之規定，致使獸醫師以無法取得動物用藥品治療動物，訴諸媒體。立法者乃於2014年修正動物保護法，允許獸醫師在治療動物疾病之藥物如有不足時，得使用經行政院農業委員會公告之人用藥物類別，使用於犬、貓及非經濟動物。由於法條只允許獸醫師使用人用藥，未就獸醫師如何流通取得人用藥納入規範，致藥師團體認為應比照先進國家，獸醫師應開具處方箋由藥師調劑，建立監督管理機制；獸醫師團體則認為藥師並不具備獸醫學知識，無法苟同，爭議數年，猶未解決。本文乃就現行相關法律條文，分析問題本質，探討人用藥品如何適法流通給獸醫師使用於寵物，提出解決之道。
It is prohibited according to Pharmaceutical Affairs Act to sell veterinary medicinal products by any pharmaceutical companies and pharmacies, and restricted to distribute the human medicine only within the medical institutions, pharmaceutical companies and pharmacies. In 2012, the Public Health Bureau imposed penalties on pharmaceutical companies which sold human medicinal products to veterinary clinics for using on animals, which was in violation of regulations of Pharmaceutical Affair Act. The veterinarians couldn’t obtain medicinal products for treating animals and resorted to the medica consequently. In 2014, the legislator amended the Animal Protection Act to allow veterinarians to use the types of human medicine announced by the Council of Agriculture, Executive Yuan, for dogs, cats, and non-economic animals when there were insufficient medicinal products to treat animal diseases. Because it is allowed for the veterinarian to use the human medicine according to the legal norms but there was no mention how the veterinarian could obtain them. The pharmacist group was the opinion that, comparing with the modern countries, the veterinarians should prescribe for the pets and let the pharmacist make up the prescription; by doing so would an institution be built. However, the veterinarian groups rejected it because it lacked the veterinary science for the pharmacist. The dispute stands for years and doesn’t be solved. In this essay, the current legal norms regarding the issue would be compared, analyzing the nature of the issue, discussing how the human medicine could be legally used by the veterinarians for the pets, and find a possible solution.
