On Employer Liability for Workplace Bullying Prevention in Medical Institutions
本論文探討於新修正之職業安全衛生法規範下,醫療院所雇主防治職場霸凌與不法侵害之法律責任。新法雖明確界定霸凌定義並課予雇主事前與事後防治義務,但在缺乏社會共識與規範密度不一的情形下,實務判斷仍具挑戰。尤其醫療行為攸關生命安全,醫療院所如何在嚴格業務要求與霸凌界線間進行審慎調和,並有效區分內部霸凌與外部不法侵害,為雇主當前最艱鉅之課題。本論文期能為醫療機構建構友善職場環境提供相關法制指引。
This study explores the employer’s liability for preventing workplace bullying and unlawful infringements in medical institutions under the newly amended Occupational Safety and Health Act. Although the new amendment defines workplace bullying and imposes preventive and remedial obligations on employers, challenges remain in practical application due to a lack of social consensus and variations in regulatory intensity. Given that medical practices directly affect patient life and health, balancing strict operational demands with the boundaries of bullying is crucial. Moreover, differentiating between internal bullying and external unlawful infringements presents a significant challenge for healthcare employers. This study aims to provide legal guidance for medical institutions to foster a safe and friendly workplace environment.
