美國法上有所謂「禁止法人介入醫療原則」,目的為防止外部人對於醫療專業之介入,美國大部分州法承認系爭原則,並衍生出例外,但終歸以醫療法人對於醫療專業之維護為首要目標;雖然臺灣醫療法定有醫療法人之類型,但依照醫療法第2條之規定,醫師仍應為臺灣醫療院所之核心,且主管機關對於醫療法人之定位仍為公益法人,故為防止外部人控制、忠實義務分歧及過度商業化,應參考美國法為醫療專業之維護,減緩外部人介入醫療之負面影響。

英文摘要

“Corporate practice of medicine doctrine” in the United States is a principle aiming at preventing outsiders from intervening the decisions of medical professionals. Most of the state in the United States recognize the doctrine, and developed exceptions. However, the maintenance of medical professionals is the primary goal all the time. Although there is Medical Juridical Persons in Medical Care in Taiwan’s law, in accordance with the interpretation of section 2 of the Medical Care Act, “doctors” should still be the core. With the charitable attitude of authorities, by applying the principles of the doctrine, including preventing outsiders’ lay control, divided loyalty and commercialization, it could reduce negative impact of external non-professional intervention of hospitals.
