The Core Task of Hospital Administration from the Judgment of Medical Malpractice: Patient Safety

病人安全問題通常是源於系統的疏失,故改善醫院的管理制度最為重要。臺灣民事法院多以醫療法追究醫療機構的法律責任,最高法院更進一步肯認醫療機構在醫療上必要之注意包含「醫院⋯⋯、設備、能力、醫護人員有無定期按規定施以必要之在職訓練及當日配置人力、病人多寡,醫護人員有無充裕時間問診照護與其他情形,綜合而為研判」;然而,民法第188條第3項的求償權規定可能使得醫療機構的賠償責任形同虛設。本文主張,當法院向醫療機構追償時,如醫療事故原因指向系統性錯誤者,醫療機構不得向醫事人員求償,以增加醫療機構改善其制度並提升病人安全維護之動機。

英文摘要

Patient safety problems usually come from system failure which is the most important issue of hospital administration. The civil courts using “Medical Care Act” to pursue the legal responsibility of hospitals. The Supreme Court stipulates that medical personnel in the hospital should receive regular training to update their skills of patient care. In case of medical dispute, judges should consider the number of medical personnel on duty, the number of patient they cared, and the urgency of patient’s conditions. However, the claim right to medical personnel of Civil Act, No. 188c make hospitals legal responsibility useless. This article claims that hospital should not ask for payback from the medical personnel while hospital with system failure should pay for the damage of the patient. So that hospitals have motivation to change their system to improve patient safety.
