On the Impact of Medical Practice After the Amendment of Article 82, Medical Care Act
After two decades of hard work, Legislator Dr. Chiu Tai-Yuan etc. proposed an amendment of Medical Care Act regarding the reasonableness of criminal and civil liability in medical malpractice. Under the earnest hope of members of Taiwan Medical Assocation, the amendment passed at the Legislative Yuan at the end of 2017. Not only does the amendment helps health care providers feel relieved in their practice, but it also safeguards the judiciary, and patient as well, by indicating a well-defined standard and criteria for malpractice liability. We hope, through this historic amendment, restoration of the era of mutual trust and good doctor-patient relationship would be possible, in the meantime defensive medicine diminished, misplacement of medical resources avoided and finally the number of medical dispute cases reduced.
