Labor Rights of Nursing: On the Dispute of the Affirmation of Pays

資遣費係以「平均工資」作為計算基礎，從而工資的意義與範圍至關重要。本文將介紹一則護理人員遭雇主終止勞動契約而向雇主請求資遣費，但雙方卻對工資的範圍有所爭執之判決，本文擬藉此判決說明工資的意義與範圍。

A severance pay is based on the “average pay.” It’s meaning and range are therefore very important. A judgment would be introduced in this article that a labor contract of one of the nursing staff was terminated and the severance pay was required at the same time. However, both of them had disputes on the range of the pay. By introducing this judgement, the meaning and the range of the pay would be discussed.
