The Same-Sex Partner Be Not Allowed to Find the Surrogate Mother for Offspring?
According to medical estimates, there are 5000 to 10000 women in Taiwan who can not get pregnant through their own womb. Because of the current multiplication restrictions of the existing artificial reproductive laws, many women have gone abroad to seek assistance for surrogate mothers. Taiwan first drafted the legislation on surrogate motherhood in 1996, and the draft amendment of the artificial reproductive law was finally with drawed in October 2016 and it has not yet been clearly formulated. And to observe the legislative process of artificial reproductive law is immer quitely paying attention to the surrogate motherhood about the heterosexual marriage, ignoring the reproductive rights of same-sex partners. The issues of surrogate motherhood involve ethics, religion and the rights and interests of women. In this paper, the subissues of “whether same-sex partners can find a surrogate mother for offspring or not?” is discussed at the core of the discussion, and it’s possibility of legitimacy in Taiwan is analyzed. This makes the draft amendment of the artificial reproductive law to it’s future adjustments.
