臺灣藥品專利訴訟之觀察──兼論專利連結制度的影響【本期企劃】 試閱
Observation of Pharmaceutical Patent on Patent Infringement Litigation in Taiwan: Also on the Impact of the Patent Linkage System
在臺灣，專利連結制度自2019年8月20日開始施行，業界反應兩極，反對者認為對於臺灣以學名藥為主的產業會有不利影響，但經統計，在藥品專利訴訟中，學名藥廠的勝訴率其實比原廠高，究其原因，發現大部分專利無效的案例中，欠缺進步性是主要的因素。本文擬藉此討論專利進步性的審查標準，並期盼法院判決能更細緻地在理由構成上呈現具有可預期的參考標準。
The patent linkage system in Taiwan came into effect on August 20, 2019, and the various industries in Taiwan have reacted differently. Opponents believe that there will be an adverse effect on the industry dominated by generic drugs in Taiwan. However, according to the statistics, the success rate for the generic drug industry is much higher than that for the name brand drug industry. The major reason that patentees have lost in litigation may be their failure to demonstrate the required inventive step. This article will discuss the criteria for the review of the inventive step of inventions, and hopes that court judgments can present a more predictable standard for determination of the same.
